Official Contest Rules
The following constitutes the official rules (“Contest Rules”) of the July 2019 Getty SING! Giveaway (“Contest”) to be conducted by Family Stations, Inc. (“Family Stations”). In addition to the Contest Rules, entrants in the Contest are subject to Family Stations’ General Contest Rules.
Contest
The Contest will consist of five (5) drawings as explained below.
Family Stations
The sponsor of the Contest is Family Stations. The prizes, as defined below, to be awarded in the Contest are to be provided by Getty Music, Inc.
Eligibility
No contribution or purchase is required to enter or win. A contribution or purchase will not increase your chances of winning. This Contest is open to all U.S. residents thirteen (13) years or older at the time of entry. Employees and agents of Family Stations and their respective household or immediate family members are not eligible to enter. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren. The term “household members” refers to people who share the same residence at least three (3) months out of the year. Only one (1) winner per household or family is permitted. Entrants may not use an assumed name or alias. Family Stations retains full and exclusive discretion to determine compliance with the eligibility requirements stated herein. All Federal, State, and local laws and regulations apply. Void wherever prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement to these Contest Rules, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Contest Period
The Contest will begin at 12:00 AM, July 1, 2019 (Eastern Time), and end at 11:59 PM, July 31, 2019 (Eastern Time) (the “Contest Period”). Relevant entry periods for each of the five (5) specific drawings are outlined below, and must be complied with in order to be eligible for each specific drawing.
Entries
Only one (1) entry per drawing will be allowed. Entrants must provide their full name, address, telephone number, and email address. Contest entries may be made online at www.familyradio.org/winsing. All entrants must agree to Family Stations’ Submission Terms and Conditions at the time of entry. FAMILY STATIONS RESERVES THE RIGHT TO USE ALL CONTEST ENTRIES FOR REASONS RELATING TO PUBLICITY, PROMOTION, FUNDRAISING, AND/OR ADVERTISING BY AND WITH REGARDS TO FAMILY STATIONS IN ACCORDANCE WITH ITS SUBMISSION TERMS AND CONDITIONS EXCEPT AS PROHIBITED BY LAW.
For individuals entering the Contest online, entrants must provide all requested information, including, their first name and last name, complete address, city, state, zip code, email address, and telephone number. Entrants are automatically opted into Family Stations’ email list and may also choose to opt-in to Getty Music, Inc.’s email list. Family Stations is not responsible for problems occurring with the website provided for online Contest entries which either inhibit or increase the chances of winning the Contest permitting online entry. In the case of website malfunctions, the decisions concerning the outcome of the affected Contest by Family Stations will be final.
Family Stations is not responsible for lost, late, delayed, or illegible entries. Family Stations assumes no responsibility for computer system, hardware, software, or program malfunctions or other errors, failures, damages, delayed computer transactions or network connections, whether human, technical, or otherwise in nature, in conjunction with its Contests participation or in connection with any prize acceptance. Family Stations, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or otherwise violating these Contest Rules. Entrants agree that Family Stations has the sole right to decide all matters and disputes arising with respect to any Contest and that its decision is final and binding.
Winner Selection and Odds of Winning
Odds of winning any prize to be awarded in the Contest depend on a number of factors, including, but not limited to, the number of eligible entries received by Family Stations during the Contest Period and the number of entrants participating at any given time.
POTENTIAL CONTEST WINNERS ARE SUBJECT TO VERIFICATION BY FAMILY STATIONS WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. Potential winners must continue to comply with all terms and conditions of these Contest Rules and winning is contingent upon fulfilling all requirements. Potential winners will be notified by mail. In the event that a potential winner of a Contest prize is disqualified for any reason, Family Stations may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries, or other means chosen by Family Stations and indicated in the particular contest rules.
Prizes
In this Contest, twenty (20) winners will each receive one (1) copy of Sing! How Worship Transforms Your Life, Family, and Church by Keith and Kristyn Getty and one (1) copy of “Sing! Live at the Getty Music Worship Conference” (the “Prize”).
Five (5) Prizes will be awarded each week through a raffle drawing among all eligible entrants at the time of each drawing. The approximate retail value of the Prize is $26.98.
Winners are responsible for all taxes associated with prize receipt and/or use. Family Stations reserves the right to substitute any listed prize for one of equal or greater value for any reason. If a winner requests that a prize be mailed to him/her, and Family Stations agrees to do so, winner agrees that Family Stations will send the prize by U.S. Postal Service, and that Family Stations is not responsible for lost, stolen, or misdirected mail, and that the prize will not be replaced if it is not received by winner.
Entry Conditions and Release
By entering the Contest, each entrant agrees to: (a) comply with and be bound by these Official Rules, and the decisions of Family Stations, which are binding and final in all matters relating to any Contest; (b) release and hold harmless Family Stations, its subsidiaries, related, and affiliated companies, participating Family Stations, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising, or promoting the Contest, and each of their respective past and present officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye, or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright, or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend, and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use, non-use, or misuse of the prize.
Publicity
Participation in the Contest constitutes winner’s consent to Family Stations’ and its agents’ use of winner’s name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law. Each Contest participant acknowledges and agrees that any telephone calls placed to the Contest line may be broadcast live on a Family Stations’ station, and also may be recorded for use on-air at a later time. Winners may be required to sign a separate publicity waiver and/or release upon collecting a prize.
Consumer-Created Content
For Contest submissions, including but not limited to consumer created content, by submitting an entry, each entrant: (1) agrees that its disclosure is gratuitous, unsolicited, and without restriction, and will not place Family Stations or its Contest partners under any fiduciary or other obligation, that Family Stations is free to disclose the ideas on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to entrant; (2) acknowledges that, by acceptance of entrant’s submission, Family Stations and its Contest sponsor do not waive any rights to use similar or related ideas previously known to Family Stations or its partners, or developed by their employees, or obtained from sources other than the entrant; (3) verifies that the entrant is the owner and producer of the submitted material, and that no third party ownership rights exist to any material submitted, or, for any content included in the submission that entrant did not create or as to which entrant does not own all rights, entrant received the permission of each and every rights holder in any part of the submission to make the submission to Family Stations and to allow the content in the submission to be used as described herein; and (4) grants Family Stations a perpetual, unrestricted, worldwide, non-exclusive, royalty-free, sub-licensable (through multiple tiers) right and license to use, publish, reproduce, display, perform, create derivative works, adapt, modify, distribute, have distributed, and promote such content in any form, in all media now known or hereinafter created, anywhere in the world, for any purpose.
Taxes
All State, Local, Federal, and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded in the Contest are the sole responsibility of the winner. Valuation of prizes may be based on information given to Family Stations by the provider of the prize.
General Conditions
Family Stations may cancel the Contest or any part of the Contest, if any fraud, technical failures, or any other factor beyond Family Stations’ reasonable control impairs the integrity or proper functioning of the Contest, as determined by Family Stations in its sole discretion. Family Stations reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Contest Rules or any other promotion or in an unsportsmanlike or disruptive manner, or to be acting in violation of any federal, state, or local law. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Family Stations reserves the right to seek legal remedies including damages from any such person to the fullest extent permitted by law. Family Stations may, in its sole discretion, waive, or change any of these Contest Rules in a particular case, but will advise the public of such waiver or changes as practicable as possible after they are made.
Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance or completion of the Contest, or any part of it, for any reason, Family Stations, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, programming, or any other reason causes more than stated number of prizes as set forth in these Contest Rules to be available or claimed, Family Stations reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
Disputes
Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or connected with a Contest, or any prizes awarded, other than those concerning the administration of a Contest or the determination of the winner, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims, and causes of action arising out of or connected with a Contest, or any prizes awarded, shall be brought in California Superior Court in Alameda County, California or in the United States District Court for the Northern District of California; (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO AN ENTRANT. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Contest Rules, or the rights and obligations of entrant and Family Stations in connection with a Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the state in which the entrant’s Family Stations radio station is located or any other jurisdiction), which would cause the application of the laws of any other jurisdiction.
Entrant’s Personal Information
Information collected from each entrant is subject to Family Stations’ Submission Terms and Conditions. To the extent the Contest involves use of a third-party website, application or platform, individuals should be aware that the third party’s Privacy Policy may apply as well. Family Stations claims no responsibility for the actions of any such third party in the collection or use of entrant’s information. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of Family Stations to be used, disposed of, or destroyed in its sole discretion. Family Stations is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, or destruction, or unauthorized access to a Family Stations radio station website.
Construction
The invalidity or enforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained therein.
